MHlophe Tech Terms & Conditions

By accessing the MHlophe Tech website, client portal, mobile applications, or purchasing any services, you agree to comply with these Terms & Conditions, the Acceptable Use Policy (AUP), and all applicable South African laws and regulations.

1. Website Usage

  • The website may only be used for legitimate browsing and service purchases.
  • Copying, reproducing, embedding, mirroring, scraping, deep-linking, or redistributing website content without written permission is prohibited.
  • Unauthorized use may violate copyright, trademark, and intellectual property laws.

2. Mobile App & Client Portal

  • The mobile control panel and client portal are governed by all standard Terms & Conditions.
  • Purchases made through the client portal are processed immediately using the selected payment method.
  • Password confirmation may be required before completing purchases.
  • Month-end maintenance windows may temporarily affect access to the control panel.

3. Service Availability

  • All services are provided on a best-effort basis unless otherwise stated.
  • Uptime, speeds, latency, and bandwidth availability are not guaranteed.
  • Maintenance, upgrades, upstream outages, or third-party infrastructure failures may interrupt services.
  • MHlophe Tech reserves the right to modify, suspend, or discontinue services at any time.

4. Billing & Payments

  • All services are billed in advance.
  • Renewal services are processed on the first working day of every month.
  • Failed debit orders or unpaid invoices may result in immediate suspension.
  • Debit orders cannot be stopped after the 24th of the month.
  • Hardware purchases, upgrades, activations, and top-ups may be billed separately.
  • Payments must reflect before services are provisioned or renewed.
  • Service fees charged by payment processors are non-refundable.

5. Debit Order Authorization

Clients authorize MHlophe Tech to collect recurring monthly service fees and other approved charges from their nominated bank account or card. Payment collections may automatically retry when funds become available.

6. Service Changes

  • Upgrades and downgrades are billed on a prorata basis.
  • New services may only be downgraded from the second month onward.
  • Clients may not upgrade and downgrade the same service during the same billing cycle.
  • Downgrade restrictions may apply on promotional or contracted services.

7. Fibre, DSL, Mobile & VoIP Services

  • Network capacity and throughput are managed according to available infrastructure.
  • Traffic shaping, throttling, or protocol management may apply to uncapped services.
  • The maximum achievable speed depends on infrastructure and line quality.
  • Additional installation costs such as trenching or pipe clearing are payable by the customer.

8. Fair Usage Policy (FUP)

  • Uncapped services may be subject to Fair Usage thresholds.
  • After threshold usage is reached, speeds may be reduced or protocols further throttled.
  • P2P and NNTP traffic may receive additional shaping.
  • FUP counters reset monthly.

9. Data Usage & Rollover

  • Prepaid data is generally valid for up to 12 months unless otherwise specified.
  • Unused rollover data may expire after the defined rollover period.
  • Transferred data retains the original expiry date.
  • Data balances may update with delays from upstream providers.
  • MHlophe Tech reserves the right to reverse transferred data if abuse or billing reversals occur.

10. Cancellations

  • Cancellations must be submitted via the Client Control Panel.
  • Email or telephonic cancellations are not accepted unless approved in writing.
  • A minimum calendar month notice may apply.
  • Promotional services may carry additional cancellation penalties or early termination fees.
  • Cancelled services may not always be recoverable or reactivated.

11. Promotions & Discounts

  • Promotional pricing applies only for the advertised period.
  • Standard pricing automatically applies after the promotional period ends.
  • Promotions generally apply to new purchases only.
  • Migrations, upgrades, service changes, and pre-orders may not qualify.
  • Promotions may be changed or withdrawn without notice.

12. Hosting & Domain Services

  • Hosting and domain services are subject to additional service-specific terms.
  • Domain registrations are governed by applicable registry policies.
  • Clients remain responsible for all hosted content and domain usage.
  • MHlophe Tech is not liable for third-party claims arising from reseller or hosted services.

13. Identity Verification (FICA/RICA)

Clients may be required to provide identity verification and proof of address documentation before activation.

Accepted Identity Documents

  • South African ID book or smart ID card
  • Temporary ID documents
  • Valid South African passport
  • Passport or visa for foreign nationals

Accepted Proof of Address

  • Municipal account
  • Bank statement
  • Lease agreement
  • Telephone account
  • Retail account statement

14. Acceptable Use Policy (AUP)

  • Illegal, abusive, fraudulent, or harmful activity is prohibited.
  • Spam, malware, phishing, hacking, and network abuse are strictly forbidden.
  • Clients may not infringe intellectual property rights or distribute unlawful content.
  • Services may not be used to violate South African law or ICASA regulations.

15. Billing Disputes

  • Clients must raise billing disputes in good faith.
  • Disputes regarding incorrect charges, payments, or adjustments will be investigated.
  • Supporting documentation may be requested.

16. Credit Vetting

MHlophe Tech may perform credit verification checks through registered credit bureaus before approving certain services or products.

17. Privacy & Personal Information

  • Personal information is processed according to applicable privacy legislation.
  • Client information may be used for billing, service provisioning, support, fraud prevention, and legal compliance.
  • Information may be shared with upstream providers where required for service delivery.

18. Liability Disclaimer

  • Services are provided “as is” without warranties unless explicitly stated.
  • MHlophe Tech is not liable for indirect, consequential, or third-party losses.
  • Clients use all services at their own risk.

19. Changes To Terms

MHlophe Tech reserves the right to amend these Terms & Conditions at any time. Continued use of services after updates constitutes acceptance of the revised terms.

20. Support & Contact

Support requests, billing queries, cancellations, and service changes must be submitted through official MHlophe Tech communication channels or the client control panel.
