Fair Usage Policy (FUP)
MHlophe Tech applies a Fair Usage Policy (“FUP”) to selected uncapped and high-usage services to ensure consistent network performance and fair access for all customers.
1. Purpose of the FUP
The Fair Usage Policy is designed to protect overall network stability, maintain service quality, and prevent excessive or abusive usage patterns that may negatively affect other customers on the network.
2. Applicability
- The FUP applies primarily to uncapped internet products and selected high-capacity services.
- Capped services may also be subject to traffic management during periods of congestion.
- The FUP thresholds and management rules may differ between packages and network providers.
3. Network Management
- MHlophe Tech reserves the right to apply traffic shaping, protocol prioritisation, throttling, or speed adjustments where necessary.
- Real-time services such as web browsing, video conferencing, VoIP, streaming, gaming, and business-critical traffic may receive priority over non-essential traffic.
- Peer-to-peer (P2P), NNTP, torrent, automated backup, and large-volume download traffic may be deprioritised during periods of network congestion.
4. Fair Usage Thresholds
- Each uncapped product may include a monthly Fair Usage threshold.
- Once the applicable threshold is reached, the service may be shaped, throttled, or managed until the next monthly reset period.
- Thresholds are determined based on package type, speed profile, and network capacity requirements.
5. Abuse Prevention
- Services may not be used for unlawful, harmful, or abusive activities.
- Continuous excessive usage that negatively impacts network stability may be investigated.
- Commercial redistribution, automated mass traffic generation, public proxy hosting, and resale without authorization are prohibited.
- MHlophe Tech reserves the right to suspend or restrict services where abuse is detected.
6. Temporary Restrictions
- Traffic management measures may be applied dynamically during peak usage periods.
- Network performance may vary depending on demand, upstream provider capacity, and infrastructure limitations.
- Speed reductions applied under the FUP are generally temporary and reset during the next billing cycle.
7. Business Services
- Business and premium services may receive different traffic management profiles.
- Dedicated and uncontended services may be exempt from standard FUP thresholds where specified.
8. Monitoring & Enforcement
- Usage monitoring may be conducted to maintain network integrity and enforce the FUP.
- Repeated violations or attempts to bypass FUP controls may result in suspension or termination of services.
- MHlophe Tech reserves the right to investigate abnormal usage patterns.
9. Amendments
MHlophe Tech reserves the right to modify Fair Usage thresholds, traffic management policies, and enforcement procedures at any time without prior notice.
